How ClearPath Supports You

FSVP Compliance

We help US importers meet Foreign Supplier Verification Program (FSVP) requirements — the single most important federal regulatory obligation for any food imported into the US.

Learn More →

US Agent

FDA-registered facilities outside the US must designate a US Agent. ClearPath can serve as your designated US Agent, handling communications with the FDA on your behalf.

A Note for Philippine Exporters

The Philippines has long been a top beneficiary of the US Generalized System of Preferences (GSP), which historically provided duty-free treatment for thousands of tariff lines including coconut products, tropical fruit, and seafood. The GSP program has lapsed pending Congressional reauthorization, and Philippine goods currently enter the US at standard Most Favored Nation (MFN) duty rates until it is renewed.

Important: tariff programs like GSP only affect duty rates — they have no bearing on FDA registration, FSVP, or labeling requirements, which apply identically regardless of country of origin or trade preference status. Whether or not GSP is in effect, FDA compliance is still mandatory before your shipment can legally enter the US.

Tariff and trade policy can change. This information is current as of July 2026. Check the Office of the US Trade Representative (USTR) or US Customs and Border Protection (CBP) for the latest official rates.

Common Questions from Philippine Food Exporters

Yes. Under the Food Safety Modernization Act (FSMA), every foreign manufacturing facility exporting food to the US must register with the FDA, and registration must be renewed between October 1 and December 31 of every even-numbered year. Products from unregistered facilities are detained on arrival.
The Foreign Supplier Verification Program (FSVP) is an FSMA obligation that applies to food imported into the US. The US importer is legally required to verify that the foreign supplier (such as your Philippine facility) has adequate food safety measures in place. Shipments without a valid FSVP risk being detained.
Yes. If you don't have your own US company or importer, ClearPath can serve as your Importer of Record (IOR). This means we take on the legal responsibility for communications with CBP (US Customs and Border Protection) and the FDA. IOR service pricing is quoted based on shipment volume and container size.
Yes. We offer FDA label compliance review, checking mandatory declarations, allergen statements, nutrition facts panel format, net weight, country-of-origin information, and English-language requirements. Non-compliant labels are a common reason shipments from the Philippines to the US get detained.
Yes. We partner with licensed US customs brokers who specialize in food imports and can make a referral. The broker handles filing CBP entries and ISF submissions at the US border, which is separate from the compliance documentation services ClearPath provides.
Yes. ClearPath works directly with your Philippine facility to complete FDA registration, review product documentation, and guide you through food safety compliance requirements. We communicate clearly in English throughout the process to make sure compliance requirements are understood and carried out correctly.
Yes, provided your labels meet FDA requirements, your manufacturing facility has completed FDA registration, and your US importer has FSVP compliance procedures in place. Brand owners typically also need to designate a US Agent to handle routine FDA correspondence.
It varies. FDA facility registration is typically completed within 48–72 hours. FSVP plan development usually takes 2–3 weeks. Label review typically returns results within 5–7 business days. If your shipment is arriving soon, contact us right away — we can accommodate urgent timelines.
