✓ Steps ClearPath handles for you

How ClearPath Helps

From registration to customs clearance, we're with you every step of the way

FDA Facility Registration

Register your production facility with the US FDA. Under FSMA, all foreign facilities exporting food to the US must register and renew every two years.

Learn More →

FSVP Compliance

Ensure your US importer meets Foreign Supplier Verification Program (FSVP) requirements. This is the most important federal regulatory obligation for all food imported into the US.

Learn More →

US Agent

Every FDA-registered facility outside the US must designate a US-based agent. ClearPath can serve as your designated US Agent, handling communications with the FDA.

Learn More →

Importer of Record (IOR)

No US company? No problem. ClearPath can serve as your Importer of Record, taking on legal responsibility for dealing with CBP and the FDA, so you can start importing without first establishing a US entity.

Special Considerations for Australian Exporters

Australia benefits from the Australia-United States Free Trade Agreement (AUSFTA), which eliminates or reduces US import duties on most Australian food products. Some tariff-rate quotas (TRQs) still apply, particularly for beef and dairy - your customs broker will confirm AUSFTA eligibility and the correct HTS duty treatment for your specific product.

Beef and lamb are regulated by USDA FSIS, not FDA - FSVP does not apply to these products. Australian meat establishments must be listed on the FSIS eligible establishments list and have passed FSIS equivalence audits confirming Australian food safety standards meet US requirements. Each shipment also requires FSIS inspection at the US port of entry, separate from FDA oversight.

Seafood is regulated by FDA under 21 CFR Part 123 (Seafood HACCP) rather than the standard FSVP framework, and is a high-priority category for FDA import sampling. Wine, beer and spirits fall under the Alcohol and Tobacco Tax and Trade Bureau (TTB), which requires a Certificate of Label Approval (COLA) before importation - not FDA.

Tariff and trade policy can change. This information is current as of July 2026 - please confirm current rates and eligibility with USTR, CBP, USDA FSIS, or ClearPath before exporting.

Frequently Asked Questions from Australia Food Exporters

Yes, for most product categories. Under the Food Safety Modernization Act (FSMA), foreign facilities that manufacture, process, pack, or hold food for export to the US must register with the FDA and renew registration between October 1 and December 31 of every even-numbered year. Beef, lamb and certain egg products regulated by USDA FSIS follow a separate establishment-eligibility pathway instead of FDA registration.
The Foreign Supplier Verification Program (FSVP) is a mandatory FSMA requirement for FDA-regulated food imported into the US — covering most Australian seafood, dairy, produce, packaged foods and specialty ingredients. Your US importer must verify that the Australian supplier has appropriate food safety measures in place. FSVP does not apply to beef, lamb or other USDA FSIS-regulated meat products, which follow a separate FSIS equivalence pathway.
Yes. If you don't have your own company or importer in the US, ClearPath can serve as your Importer of Record (IOR), taking on legal responsibility for dealing with CBP and the FDA. IOR service fees are quoted based on cargo volume and container size.
Yes. Australian labels prepared for the domestic market will not meet US requirements — the Nutrition Facts panel format differs from the Australian/NZ format, and sesame is now a major allergen under the FASTER Act. We review mandatory declarations, allergen labeling, nutrition panel formatting, net quantity in US customary and metric units, and country-of-origin information before shipment.
Yes. We partner with licensed US customs brokers experienced in AUSFTA duty-preference claims and food imports, and can refer you to them. The broker handles CBP entry filing and Prior Notice submission at the US border, which is separate from ClearPath's compliance documentation work.
Yes. ClearPath can work directly with your facility in Australia to help complete FDA registration (or FSIS establishment listing for meat products), review product documentation, and provide guidance on food safety compliance requirements throughout the process.
Yes, provided your labeling meets FDA requirements, your facility has completed FDA registration (or FSIS listing for meat), and your US importer has established FSVP compliance procedures. Brand owners typically also need to designate a US Agent to handle day-to-day FDA communications.
Allow 4-8 weeks for full setup, covering FDA facility registration, FSVP plan preparation, US entity formation (if required), and customs broker engagement. FDA facility registration itself is typically completed within 48-72 hours. If your shipment is arriving soon, contact us right away — we can expedite urgent cases.
